According to a federal government order issued on October 11, the governor will perform provincial government functions on behalf of the federal government with assistance from the advisory council.

The council includes Tariq Mahmood Pasha, Dr Aamir Abdullah, retired Lieutenant General Nigar Johar, Samar Bilour, Dr Sarfaraz Ali, Aamir Javed, Dr M Irshad, Kifayatullah, Tayyab Qureshi, Usman Saifullah Khan and Asif Rafiq.

The order also appoints Sanaullah Advocate as the advocate general of Khyber Pakhtunkhwa.

It states that provincial government affairs will be conducted in accordance with the relevant constitutional provisions and the Khyber Pakhtunkhwa Government Rules of Business, 1985, in line with the federal government's order. The order takes immediate effect.

President Asif Ali Zardari signed the proclamation of emergency in Khyber Pakhtunkhwa under Articles 232(1) and 234(1) of the Constitution, citing an increase in terrorist attacks and a serious law and order situation.

According to the President's Secretariat, the escalation in terrorist incidents has posed serious threats to the lives and property of citizens, government installations, infrastructure and law enforcement agencies.

The statement said the provincial government had failed to take the required measures to prevent terrorism and lawlessness. It also referred to a report by the KP governor highlighting disruptions in the constitutional system and the provincial government's alleged failure to conduct its affairs in accordance with the Constitution.

Under the federal notification, the governor has been authorised to exercise powers and perform functions assigned by the federal government. The notification also provides for provincial assembly powers to be exercised by Parliament or a designated body.

The order further states that the chief minister, provincial ministers, advisers, special assistants and advocate general will immediately cease to hold their respective offices.
